How long should I wait after sending my Florida Notice to Surrender Letter (form#82192) to mail my Florida Notice or Discharge of Repo Recovery Attempt (form#82191) to the DHSMV in Tallahassee?
There is no official process timeline. We suggest waiting 5 business days for a response from the customer before notifying the DHSMV. However it is totally up to you.
What do I have to send in order to place the record stop with the DHSMV?
Yes. The stop must be removed when the delinquent vehicle is returned. You must fill out the discharge section on the Florida Notice or Discharge of Repo Recovery Attempt form, sign it and mail it in to the DHSMV in Tallahassee.
Do I have to send the Florida Notice or Discharge of Repo Recovery Attempt form to the DHSMV with any proof of mailing?
No. Only the Florida Notice to Surrender Letter must be sent with proof of mailing.
If the customer returns the vehicle to me after the record stop has been placed, am I required to remove the stop?
Yes. The stop must be removed when the delinquent vehicle is returned. You must fill out the discharge section on the Florida Notice or Discharge of Repo Recovery Attempt form, sign it and mail it in to the DHSMV in Tallahassee.
If a stop has been placed on a vehicle then the vehicle is returned and the stop has been removed, if the customer goes delinquent and will not return the car again can the stop be placed back on the vehicle?
Yes. You would just repeat the same process again.
If I have not filed my lien with the DHSMV, can I still place the record stop?
No. The record stop can only work off of the lien filed with the DHSMV.
